Now that postal liberalisation has reached its final phase (Directive 2008/6/EC had to be transposed into national law by 16 Member States (about 95 % of the market) on 31.12.2010, 11 more will follow on 31.12.2012), it is critical for the European Commission to take all necessary and timely actions to ensure that the legal framework will be applied soundly, and that postal markets can function effectively and to the benefit of postal users.The postal sector is evolving substantially. Postal operators are facing strong competition from electronic means of communication, Internet and mobile communication methods. In response to these developments, postal operators have improved their efficiency considerably by restructuring their operations thus resulting in cost efficiencies and better quality of service. Many postal services providers have developed new marketing strategies in order to foster demand. They have evolved into complex modern industrial organisations, benefiting from technology developments to seize new opportunities and new ways of providing services, greater innovation, and a more dynamic promotion of the mail media. In this context, different pricing policies and strategies have been introduced. National regulatory and competition authorities are tasked with establishing that these operations and business models are fully compatible with the postal 'acquis' and general principles of competition law. This helps to ensure that price-related developments do not hold back the growth of competitive market structures or have a detrimental impact on postal users and make a positive contribution to the evolution of postal markets. Against this background it is important to understand how, on the one hand, different pricing behaviour of postal operators, and, on the other, the regulatory intervention and tools introduced by Member States, affect postal markets and postal users. A comprehensive overview and analysis of these issues and their interplay will provide the necessary information to assess whether existing regulatory tools are sufficient and which regulatory features and instruments may require further focus.The study will provide a comprehensive assessment of pricing developments and the pricing behaviour of postal operators in the European postal sector; identify important trends, and assess the factors which have affected pricing strategies. It will analyse regulatory tools and regulatory experience in the light of the pricing and cost requirements of the applicable legal framework, provide a comprehensive analysis on the impact of pricing behaviour and price regulation on both postal markets and postal users and identify best regulatory practices.
