Die EADS Real Estate Dornier Grundstucke GmbH & Co. KG (RE-Do) ist Grundstuckseigentumerin des Sonderflughafens Oberpfaffenhofen. Die EDMO ist seit 1.1.2003 Inhaberin der luftrechtlichen Genehmigung und hat die Flugbetriebsflachen von der RE-Do angemietet. Weiterhin ist die EDMO gemass Uberlassungsvereinbarung vom 27.11.2002 mit dem DLR Nutzungsberechtigte an weiteren Teilflachen der Start- und Landebahn (Flur-Nr. 1048, 828; ca. 213 275 m2). In der luftrechtlichen Genehmigung ist das DLR in Abschnitt A, Ziffer VI.3.1) unter der Voraussetzung einer entsprechenden Vereinbarung als Nutzungsberechtigter des Sonderflughafens aufgefuhrt. Unter Bezugnahme hierauf vereinbarten die Parteien einen Mitbenutzungsvertrag. Aus diesem wird nun Jahr fur Jahr ein sogenannter Abrufauftrag an die EDMO platziert.Argumente zu Gunsten einer unmittelbaren Auftragsvergabe an das Unternehmen EDMO-Flugbetrieb GmbH:1. Da sich der Sonderflughafen in unmittelbarer Nahe des DLR befindet (Grundstuck an Grundstuck), sind keine wirtschaftlich sinnvollen Alternativen moglich;2. Im Falle dieser duchzufuhrenden Beschaffungsmassnahme fur das Geschaftsjahr 2015 handelt es sich um einen Abrufauftrag aus Basis des o. a. Vertrags zwischen der EDMO und dem DLR.Awards
