Het gaat in dit kader om de inkoop/inzet van 5 trucks met grijpkraan. Aangezien het hier ging om noodhulp aan Caribisch Nederland zijn deze opdrachten met spoed verstrekt, want er waren geen bestaande overeenkomsten voor bovengenoemde opdrachten. In de Aanbestedingswet (AW) staat aangegeven dat bij onvoorziene dwingende spoed de onderhandelingsprocedure zonder aankondiging toegepast kan worden (artikel 2.32 lid 1 sub c AW). Dit is bij de betreffende opdrachtverlening van toepassing geweest, want vanwege dwingende spoed was het niet mogelijk om de opdracht op de gebruikelijke wijze aan te besteden.
