Siendo el plazo de entrega de 3 meses contados a partir del dia siguiente a la recepcion de la notificacion, que se produce el 1 de Junio. 2.- Que en fecha 2 de Agosto de 2022 mediante escrito presentado en registro de entrada, y por tanto dentro del plazo de ejecucion referido, la empresa citada manifiesta no poder entregar el suministro, debido a la situacion actual del mercado y de la subida de precios de los materiales. Considerando: 1.- Que la Ley 9/2017, de 8 de noviembre, de Contratos del Sector Publico (LCSP), no se refiere a la renuncia del contratista, a diferencia del desistimiento de la Administracion, como causa de resolucion. Resulta, por tanto, dificil obligar a cumplir a quien no esta en disposicion de ello y asi lo ha manifestado expresamente. En uso de la facultad que me confiere la legislacion vigenteAwards
